1. DEFINITION AND SCOPE OF THE CONTRACT
1.1 This agreement ("Agreement") is a distance contract pursuant to Art. 50 and ss. Legislative Decree no. September 6, 2005, n. 206 ("Consumer Code"). The Contract for the sale of goods between CHEIMIKA SAS DI HEIM JURGEN with registered office at Pellezzano (SA) Via della Quercia, 25 VAT IT 05317000650 ("CHEIMIKA SAS DI HEIM JURGEN") and the customer ("Customer"). The Contract is concluded directly through the acceptance by CHEIMIKA SAS DI HEIM JURGEN a proposal for purchase from the customer by telephone or via the Internet, following the invitation to offer contained in teleshopping broadcasts, the web site www.cheimika.it (the "Site") and / or through other means of distance selling of CHEIMIKA SAS DI HEIM JURGEN, based on the procedures described in Article 3 below.

2. PRICES
2.1 - The selling prices of the products shown on the Site CHEIMIKA SAS DI HEIM JURGEN include VAT and all other taxes. Delivery costs are included in the price shown on the site.

3. HOW TO PURCHASE AND PAYMENT
3.1 - The customer will be allowed to choose one of the following methods of payment: (a) in cash, to be carried out to courier who delivers the product, or (b) through any other means of payment from time to time indicated as valid by CHEIMIKA SAS DI HEIM JURGEN via transmissions on the Site

4. DELIVERY OF PRODUCTS - COMPLAINTS

5. AVAILABILITY OF PRODUCTS
5.1 - CHEIMIKA SAS DI HEIM JURGEN also accepts Customer's orders also for non-availability warehouse products that will then be reinstated as soon as possible. Therefore, the acceptance by CHEIMIKA SAS DI HEIM JURGEN of the purchase proposal submitted by the Customer is not subject to the immediate stock availability of the products themselves. CHEIMIKA SAS DI HEIM JURGEN undertakes to promptly inform the Customer of any unforeseeable depletion of stocks due to excess demand or other causes.

6. WARRANTY AND SERVICE
6.1 - For products purchased by the customer are applicable to CHEIMIKA SAS DI HEIM JURGEN rules on guarantees and assistance relating to the sale of consumer goods.

7. CUSTOMER OBLIGATIONS
7.1 - The Customer represents and warrants that: (i) to be a consumer in accordance with Art. 3 of the Consumer Code, (ii) to be of age, and (iii) that the data supplied by the same for the execution of the Agreement are true and correct.

8. RIGHT OF WITHDRAWAL n ° 206/2005
8.1 - The Customer is entitled to withdraw from the contract without penalty and without giving any reason, within 14 days of receipt of goods. The customer can exercise the right of withdrawal, within that period, showing a telephone or through written communication at the headquarters of CHEIMIKA SAS DI HEIM JURGEN in art. 4, sent by registered mail with return receipt or by telegram, telex, electronic mail or facsimile.

8.2 - Customers wishing to exercise the right of withdrawal must return the products to the address indicated on the invoice, namely CHEIMIKA SAS DI HEIM JURGEN Via della Quercia, 25, Pellezzano (SA), following the instructions in it reported, within 30 days of receipt of goods. Under Article 55, second paragraph, of the Consumer, the Customer Code will have no right of withdrawal in the following cases: - supply of audiovisual products and software were unsealed by the customer; - Supply of products tailored or custom, or which by their very nature, can not be returned or are liable to deteriorate or expire rapidly (eg. Cosmetics, flowers, food); - The supply of newspapers, periodicals and magazines.

8.3 - The product return costs are borne by the customer. CHEIMIKA SAS DI HEIM JURGEN will return, within 14 days of receipt of the products by the Customer: (i) the full price paid by the customer in case of returning the product complete with all its parts and functions; or (II) the portion of the price equivalent to the product returned by the customer who has consumed the product appreciably and / or which significantly diminish the value.

9. TREATMENT AND CONFIDENTIALITY OF PERSONAL INFORMATION ACCORDING TO THE LEG. 196/03
1.9 Pursuant to and for the purposes of the provisions of Legislative Decree of 30 June 2003, No. 196 Code on protection of personal data (Hereinafter the "Code"), we inform you that your personal data provided and / or subsequently acquired, will be handled by CHEIMIKA SAS DI HEIM JURGEN, in Italy and abroad, through electronic and manual in compliance with the Code and the regulations on privacy.

Aims of treatment
The data collected are used for the following purposes:

Data retention
All data collected will not be used for purposes other than those above and will be kept for period necessary to achieve the same. After that time, the data will be deleted or transformed into anonymous. For detailed data on purchases and services, storage times will not exceed those established by regulations.



Rights of
This does not affect your right to exercise at any time the rights under Article 7 (Right of access to personal data and other rights) of the Code, in particular: the right to access their personal information, request correction, updating and cancellation if incomplete, incorrect or collected in violation of law, and to oppose their treatment for legitimate reasons, a written request to CHEIMIKA SAS DI HEIM JURGEN Via della Quercia, 25 - 84080 Pellezzano (SA ).

10. JURISDICTION
10.1 - The Agreement is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of contract will be the court of Salerno. Mode of payment

Force Majeure
